The National Gender and Equality Commission (NGEC) convened a quarterly coordination meeting on strengthening the protection and promotion of the rights of intersex children in Kenya. The meeting provided a platform to discuss the lived realities and protection concerns affecting intersex children, gaps in the existing legal, policy and institutional frameworks, and the need for stronger and coordinated interventions.
THE PROPOSED BILL
Stakeholders deliberated on the proposed Intersex Persons Bill, 2024, including its potential role in strengthening legal recognition, protection, non-discrimination and access to essential services for intersex persons. Discussions highlighted gaps in addressing intersex challenges, including documentation and legal identity, healthcare, education, protection from harmful practices and access to justice.
BEST INTERESTS TEST
The engagement underscored the importance of placing the best interests of the child at the centre of interventions. It also underscored the strengthening of collaboration among government institutions, civil society and other stakeholders so that intersex children are protected, recognised and able to enjoy their rights and dignity on an equal basis.
